CLUB RULES
January 1998

1. The Society    shall be called "THE BANBURY AND DISTRICT DOG TRAINING SOCIETY"

2. OBJECTIVES    The aims and objectives of the Society are: to foster Obedience training for dogs, to form the members of the Society into one friendly body and to protect their interests and the interests of their dogs, to encourage a better understanding between dogs and their owners and the public at large, to enter into friendly communication with similar clubs and societies.

3. MEMBERS    Membership of the Society is open to all persons over 14 or at the Committee's discretion, whether dog owners or not, and any breed of dog, whether pedigree or mongrel. Candidates for membership shall be accepted on payment of subscription.
The Society shall make a list of members and their addresses available for inspection if so requested by the members of the Society or by the Kennel Club.

4. EXECUTIVE COMMITTEE    The Society shall be governed by an Executive Committee of up to eight members, who shall retire annually and be eligible for re-election at the Annual General Meeting. If a Committee member misses three or more meetings the Committee reserves the right to ask the member to resign. A quorum for a meeting of the Committee shall be 75% of the Committee including at least one Officer.

5.THE OFFICERS    of the Society shall be: a Chairman, a Secretary and a Treasurer. The officers shall be elected as provided for in Rule 4.

6. VACANCIES    Any vacancy occurring amongst the Officers or Committee may be filled by the Committee, who may appoint someone to fill the vacancy, but the person so appointed shall only hold office for such time as the person in whose place he/she is appointed would have held office if the vacancy had not occurred.

7. THE SECRETARY    The Secretary shall on all occasions in the execution of his/her office act under the control and direction of the Committee. He/she shall summon and attend meetings and take minutes of the proceedings and shall keep the documents and papers of the Society in such a manner as the Committee may from time to time decide. The Secretary shall bring before the Committee any matter of which he/she has received written notice of a member.

8. THE TREASURER     The Treasurer shall receive all monies due to the Society and shall pay the debts of the Society as the Committee shall from time to time direct. He/she shall whenever required to do so render to the Committee an account of the monies received and expended by him/her on behalf of the Society. Each member of the Society shall receive annually an account showing the income and expenditure of the Society and a Balance Sheet.

9. FUNDS    The Committee shall cause the funds of the Society to be deposited with the Bankers in the name of the Society into which the revenue of the Society shall be paid and from which withdrawals shall only be made on the signature of two or more Officers.
Prior to Disillusion of the Club any remaining funds will be donated to Charities as chosen by the Committee.

l0. CLUB PROPERTY    The property of the Society shall be vested in the Committee. In the event of the Society ceasing to exist, a General Meeting shall be called to decide the disposal of the Society's assets and the outcome of the meeting notified to the Kennel Club. A final statement of accounts with a record of the disposal of the property of the Society shall be forwarded to the Kennel Club within six months by the Officers and Committee of the Society who will be held responsible by the Kennel Club for the proper winding up of the Society.

11. VOTING RIGHTS    Any member who has not paid the annual subscription shall not be entitled to vote at any meeting, and there shall be no power to vote by proxy. There shall be no power to demand a Ballot but whenever the Committee shall deem it desirable to take a ballot of Members of the Society, voting papers in such form as the Committee shall prescribe shall be sent by post to every member of the Society stating for what object or objects the ballot is required, and a date shall be appointed not less than 7 days from the date of posting by which the same are to be returned to the Secretary. Ballot papers not posted by such a date shall be deemed void.

12. ANNUAL GENERAL MEETING     The financial year of the Society shall be from 1st October to 30th September. The Annual General Meeting shall be held within 7 days either side of the 31st October. The Secretary shall give notice to all members at least twenty one days prior to the date. The Nature of Business to be conducted will be the report of the Committee, the Balance Sheet and the report of the Treasurer, election of Officers and to discuss any resolution duly placed on the Agenda of which prior notice has been given to the Secretary. Items for the Agenda must reach the Secretary no later than ten days before the meeting. The Agenda will be circulated at the Meeting. No business shall be transacted at an Annual General Meeting unless notice thereof appears on the Agenda, with the exception of routine matters or those which in the opinion of the Chairman of the Meeting are urgent.

13. SPECIAL GENERAL MEETINGS    A Special General Meeting shall be summoned by the Honorary Secretary if at least 12 members send a signed requisition stating the subject to be discussed and requesting a Special General Meeting to do so. The Committee of the Society is also empowered to call a Special General Meeting. No business other than that detailed on the Agenda can be discussed at a Special General Meeting. Notice of the meeting and the Agenda will be circulated to the members by the Honorary Secretary at least fourteen days prior to the date.

14. The Society    may promote Working Trials, Obedience Shows and/or matches
under Kennel Club Rules and Regulations relating thereto.

l5. SUBSCRIPTIONS    The annual subscription shall be paid by the 31st December. In the case of Members joining after 1st August in any year the subscription paid shall carry membership to the 31st December in the following year. No member whose subscription is unpaid is entitled to any of the privileges of Membership and if the Member shall fail to pay outstanding subscription by 1st March his/her name shall be automatically erased from the register.

16. SUSPENSION OF MEMBERS    
a) If in the opinion of the majority of the Committee present at a training session, any dog brought to any training class or other function promoted by the Society, is unfit for training, or is ill or is suffering from any disease, then that dog may be either refused admission to or be removed from that training session. In the event of the Committee at the training session desiring the suspension to operate for more than one session, the member has the right to request the suspension to be brought before the next Committee Meeting of the Society whose decision shall be final.
b) The Committee reserves the right to remove from a training session any person who, in the opinion of the majority of the Committee present, use undue force or in any way attempt to train a dog by any means prejudical to that dog's welfare or who's attitude is considered a disturbance to other members training or the club in general.
c) Members shall be solely responsible for controlling their dog and the Society shall not be responsible for any damage or injury however arising or caused, suffered by a Member or his/her dog whilst attending training class or other function promoted by the Society.

17. EXPULSION OF MEMBERS    Any Member who shall be suspended under Kennel Club Rule A42j(4) and/or disqualified under Kennel Club Rule A42j(8) shall ipso facto cease to be a Member of the Society for the duration of the suspension and/or disqualification. No person whilst an undischarged bankrupt may serve on the Committee or hold any other office or appointment within a Kennel Club Registered Society.
If the conduct of the member shall, in the opinion of the Committee of the Society be injurious or likely to be injurious to the character or interests of the Society, the Committee of the Society may, at a meeting the notice convening which includes as an object the consideration of the conduct of the Member, determine that a Special General Meeting of the Society shall be called for the purpose of passing a resolution to expel him/her.
Notice of the Special General Meeting shall be sent to the accused member, giving particulars of the complaint and advising him or her of the place, date and hour of the meeting that he or she may attend and offer an explanation. If at the Meeting, a resolution to expel is passed by a two thirds majority of the members present and voting, his or her name shall forthwith be erased from the list of Members, and shall thereupon cease for all purposes to be a Member of the Society except that he or she may within two calendar months from the date of such meeting appeal to the Kennel Club upon and subject to such conditions as the Kennel Club may impose.

18. FINAL COURT OF APPEAL     The Kennel Club shall be the sole and Final Court of Appeal in all matters that may be in dispute between the Society and it's members concerning the affairs and/or management of the Society in all respects, and reference to all Courts of Law concerning such disputes is hereby excluded.

19. ANNUAL RETURNS TO THE KENNEL CLUB     The Officers acknowledge that during the month of January each year Maintenance of Title fee will be forwarded to the Kennel Club by the Secretary for the continuance of Registration and that by the 31st July each year other returns, as stipulated in Kennel Club Regulations for the registration and Maintenance of Title of Societies and Breed Councils and Affiliation of Agricultural Societies and Municipal Authorities, will be forwarded to the Kennel Club. The Officers also acknowledge their duty to inform the Kennel Club of any change of Secretary of the Society which may occur during the course of the year.

20. AMENDMENTS TO RULES    The Rules of the Society may not be altered except at a General Meeting, the Agenda for which contains specific proposal to amend the Rules. Any proposed alteration to the Rules may not be brought into effect until the Kennel Club has been advised and approved the alteration. The Committee shall have the power to deal with any question relating to the management of the Society not provided for by the Rules.

21. THE SOCIETY    shall not join a Federation of Societies or Clubs.

22. BITCHES IN SEASON     must not be brought to training
